MERE ARRESTS FOR BATTERY DOES NOT PROVE PROPENSITY FOR VIOLENCE
CPD applicant E.O. was disqualified as an applicant because he had two previous arrests for domestic battery and the department concluded that applicant had a propensity for violence. During cross-examination of the CPD's witness it was discovered that CPD failed to follow its own policies which required an investigation into the arrests at issue. The witness also confirmed that without an investigation, it could not be concluded that applicant had a propensity for violence. The Department's disqualification was reversed and applicant was ordered immediate reinstatement on the application list. 15 HRB 1126 (2016)
